Kahnawake online casinos: what the licence means

The Kahnawà:ke Gaming Commission, in the Mohawk Territory near Montreal, has licensed online gambling since 1996. Here is what its permits cover, how to check one and where the legal debate stands.

Short answer

A “Kahnawake casino” is an online casino licensed by the Kahnawà:ke Gaming Commission (KGC), set up in 1996 in the Mohawk Territory of Kahnawà:ke, Quebec. The KGC issues permits, keeps a public list of approved operators and their websites, and takes player complaints. Its authority comes from Kahnawà:ke’s own law, not from a province, so a KGC permit does not make a casino legal under provincial rules in Ontario, Alberta or anywhere else in Canada.

What the Kahnawà:ke Gaming Commission is

The KGC was established on June 10, 1996, under the Kahnawake Gaming Law adopted by the Mohawk Council of Kahnawà:ke. It regulates online gambling and land-based gaming in the territory. The Commission says its main purpose is to protect players who use its permit holders’ sites.

It bases its authority on the sovereign rights of Kahnawà:ke, as a community of Indigenous people, to govern its own affairs. Its FAQ cites a 2007 Superior Court of Québec decision that, in its words, “favourably considered” that authority.

Licence and permit types

The KGC’s Regulations concerning Interactive Gaming (latest version we found: March 25, 2026) list several types:

TypeWho holds itWhat it allows
Interactive Gaming LicenceOne hosting facility in Kahnawà:ke. Only one can exist at a time; Mohawk Internet Technologies has held it since 1999.Hosting the servers of permit holders.
Client Provider Authorization (CPA)Online operators. No limit on the number issued.Any type of interactive gaming (casino, poker, sportsbook), hosted at the licensed facility.
Casino Software Provider AuthorizationSoftware suppliers.Supplying casino software to operators. Not offering games to players directly.
Live Dealer Studio AuthorizationLive casino studios.Running live dealer games for operators.
Key Person PermitManagers and key staff of licence and authorization holders.Up to 5 years, renewable. The application fee is US$5,000 per key person.

So the permit you want to see for a casino is a Client Provider Authorization. The Commission has announced that CPA and Key Person Permit fees will rise on January 1, 2027.

How to check a Kahnawake licence

  1. Find the operating company’s name in the casino’s terms and footer.
  2. Open the list of interactive permit holders on gamingcommission.ca. It shows each operator and the website addresses approved for it.
  3. Check that both the company and the exact website address are on the list. A company listed with other URLs does not cover a site that is not named.
  4. Note the “updated” date. The list we checked on November 3, 2026 showed “Updated September 28, 2023”.

The list notes that not all URLs are accessible in all jurisdictions, so a listed casino may still refuse players from your province.

How to complain to the KGC

Complain to the casino first, in writing. If that fails, email complaints@gamingcommission.ca or use the complaint form on gamingcommission.ca. The Commission says it reviews complaints under its regulations and tries to facilitate solutions between players and operators. Send your username, dates, amounts, screenshots and the casino’s replies.

Under section 207 of the Criminal Code, only a provincial government can conduct and manage online casino games. The KGC’s position is that Kahnawà:ke’s jurisdiction does not depend on that section. Its FAQ argues that in 1985 Canada transferred its own gaming jurisdiction to the provinces in exchange for C$100 million, and that this did not affect Kahnawà:ke’s rights.

A KGC permit does not authorize a site in Ontario’s or Alberta’s regulated markets: sites there need registration with the AGCO or AGLC and an agreement with the provincial agency. The Mohawk Council of Kahnawà:ke challenged Ontario’s iGaming model in court; the Ontario Superior Court of Justice dismissed the application in 2024 (Mohawk Council of Kahnawà:ke v. iGaming Ontario, 2024 ONSC 2726). In the related Supreme Court of Canada appeal on Ontario’s pooled liquidity plan, the Council told the Court on June 15, 2026 that it would not take part.

For players outside Ontario and Alberta, the practical point is this: a KGC permit gives you a regulator to complain to, but no provincial protection.

What we check at Kahnawake casinos

  • That the operator and the exact URL are on the KGC list, with a screenshot dated the day of the review.
  • Our money test: C$50 Interac deposit, full withdrawal timed to the bank.
  • Whether the terms name the KGC as the complaint route.
  • Responsible gambling tools in the account.

FAQ

Is a Kahnawake casino legal in Canada?

A KGC permit is issued under Kahnawà:ke law, not by a province. Under section 207 of the Criminal Code, provinces conduct and manage gambling, and a KGC permit is not a provincial authorization. In Ontario and Alberta, only registered sites are legal.

Where is Kahnawake?

Kahnawà:ke is a Mohawk territory on the south shore of the St. Lawrence River, near Montreal, Quebec.

How do I know a casino really has a KGC permit?

Find the operator and the exact website address on the permit holder list at gamingcommission.ca. A logo on the casino’s site is not proof.

Will the KGC get my money back?

It can review a complaint and work with the operator. It cannot promise an outcome. Keep all records and complain to the casino first.
